"In March 2011, it was announced that the original 269 minutes version was to be re-created by a film lab in Italy under the supervision of Leone's children, who acquired the Italian distribution rights, and the film's original sound editor, Fausto Ancillai, for a premiere in 2012 at either the Cannes Film Festival or the Venice Film Festival.[2][3] The restored film premiered at the 2012 Cannes Film Festival, but due to unforeseen rights issues for the deleted scenes, the film's restoration ran for 251 minutes.[4][5] However, Martin Scorsese (whose Film Foundation helped with the restoration), stated that he is helping Leone's children gain the rights to the final 24 minutes of deleted scenes for a complete version of Leone's original 269 minute version."
Well who the hell has the rights to the deleted shit? That's the problem. Someone ain't letting go of those scene for some reason.

Doesn't some of it only have the raw production audio?
And just to add, Leone stated in an interview before he died that the 229 minute cut was his preferred cut. He had the final edit on that version. This isn't an Orson Welles situation where the studio took the film away from him and did a hack job.

the back of the box is on blu-ray.com which confirms a few things
the "theatrical cut" is 229 minutes (so the chopped up american cut will not be included)
and
"due to the limited availability of 35mm work prints, the new inserts could not be restored to the same quality as the rest o the film"
which means either the new scenes will look like shit (like the overseas blu ray) or they "tried their best to restore them but couldn't go all the way"

Well... One would hope the reinserted bits sound good. But that's the gamble we get.
And then we still have more footage yet to see cuz of some unforeseen rights issues.
